Terms of Service

1. Who we are and what CaptureLand is
1.1
These Terms of Service (“Terms”) govern access to and use of captureland.org, related subdomains, mobile surfaces, maps, search tools, APIs, syndication endpoints, and CaptureLand-operated features (together, the “Platform”), operated under the brand CaptureLand (“CaptureLand”, “we”, “us”, “our”).
1.2
CaptureLand is a property information and discovery platform for Jamaica. It helps users search and explore parcels, addresses, valuation estimates, tax-related fields, boundaries, and mapping layers, often organised by parish and district.
1.3
Unless content is clearly marked as original CaptureLand material, much of the Platform aggregates, displays, or links to information from third parties, including public records, licensed data feeds, user submissions, and automated or model-assisted processing. CaptureLand does not guarantee that every boundary, valuation, tax figure, ownership field, coordinate, or map overlay is complete, current, or error-free.
1.4
CaptureLand is not the National Land Agency, a government registry, a licensed land surveyor, a commissioner of valuations, a real estate broker, or a law firm. Platform information is general and is not professional legal, surveying, tax, investment, or lending advice.
1.5
Official land and title matters — including registration of transfers, mortgages, caveats, plans, and proprietor changes — must be verified and completed through the National Land Agency and qualified professionals. CaptureLand is a research and discovery tool, not a substitute for an official search, certified survey, or legal opinion.
1.6
Companion products (including Jurifi, OFMOP, Abeng, EnterJamaica, MATSIL Mobile, and Inbox) may be operated separately. Your use of them is governed by their terms and policies unless we say otherwise in writing.
2. Acceptance and changes
2.1
By accessing or using the Platform, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Platform.
2.2
Where the Electronic Transactions Act applies, electronic acceptance (including clicking “I agree”, creating an account, subscribing, or continuing to use the Platform after notice) has the same effect as a written signature.
2.3
We may change these Terms. For material changes, we will give at least 30 days’ notice by email to registered users (where we have an address) and/or a prominent on-site notice before the new effective date. Continued use after the effective date constitutes acceptance. If you disagree, stop using the Platform and close your account.
3. Eligibility and accounts
3.1
Some features may be available without registration. Other features (including saved searches, membership tiers, locked fields, or authenticated tools) may require an account.
3.2
You must be 18 or older to create an account or enter a paid subscription. The Platform is not directed at children under 18.
3.3
You are responsible for activity under your account, for keeping credentials secure, and for accurate registration information.
3.4
We may suspend or terminate accounts for breach of these Terms, abuse, unlawful use, payment failure, scraping, or risk to the Platform or third parties, with or without notice where reasonably required.
4. Property data, maps, valuation, and tax information
4.1
Property records, boundaries, coordinates, imagery, and related metadata may come from government sources, commercial datasets, users, or automated processing. Display on CaptureLand does not mean we warrant official status, legal boundary accuracy, or current ownership.
4.2
Valuation estimates, confidence scores, and AI-assisted summaries or tags are estimates for information only. They are not official assessments for tax, lending, compulsory acquisition, court, or registration purposes unless we clearly state otherwise in writing.
4.3
Tax-related fields may be incomplete, delayed, or restricted. Locked or premium fields do not imply that unlocked fields are verified for every purpose.
4.4
Coordinate and map tools depend on device location, base maps, and source geometry. Do not use the Platform as the sole basis for construction set-out, fencing, subdivision, or boundary disputes.
4.5
We may correct, update, moderate, or remove content for editorial, legal, technical, accuracy, or rights reasons.
5. Membership, fees, and payment
5.1
Paid membership or feature access, where offered, is billed as shown before checkout. Payment is processed through Stripe or other designated processors. We do not store full card numbers on our servers.
5.2
Subscriptions may renew automatically until cancelled in your account or by written request using the contact details on our site. Cancellation stops future billing; access may continue until the end of the current paid period unless stated otherwise at purchase.
5.3
Except where non-waivable consumer rights apply or we expressly state a refund window at checkout, fees are non-refundable once the relevant billing period has begun or digital access has been delivered.
6. Intellectual property and permitted use
6.1
Third-party marks, government data, imagery, and partner content remain the property of their respective rights holders. CaptureLand claims rights in its brand, software, selection, layout, original material, and non-source derivative presentation.
6.2
Subject to these Terms and applicable law, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform for personal or internal organisational property research.
6.3
You must not:
- scrape, harvest, bulk-download, or systematically export the Platform in a way that impairs our systems or circumvents technical limits;
- remove attribution or misrepresent the source of data;
- republish substantial Platform content or parcel datasets commercially without permission from the relevant rights holder and, where required, from CaptureLand;
- use the Platform to train models or build competing datasets without written consent;
- misrepresent CaptureLand output as an official NLA, tax, or court record.
6.4
The Copyright Act and applicable fair dealing or licensing principles apply to reuse. Rights concerns: use the contact details on our site with subject Rights-Holder Complaint.
7. User content and conduct
7.1
If you submit tips, corrections, images, notes, or other material (“User Content”), you represent that you have the right to submit it and that it is accurate to the best of your knowledge.
7.2
You grant CaptureLand a worldwide, royalty-free licence to use, reproduce, adapt, publish, and display User Content to operate, improve, and promote the Platform, subject to the Privacy Policy.
7.3
You must not use the Platform to violate Jamaican or applicable foreign law, defame others, invade privacy, upload malware, or impersonate any person or agency.
7.4
We may remove User Content at our discretion. We are not obliged to monitor all User Content.
8. Disclaimers
8.1
The Platform is provided “as is” and “as available”. To the fullest extent permitted by law, CaptureLand disclaims warranties of merchantability, fitness for a particular purpose, accuracy, completeness, timeliness, and non-infringement for third-party and model-assisted content.
8.2
We do not guarantee uninterrupted service, error-free maps, or availability of every parcel, field, or layer.
8.3
Property, tax, legal, and investment information on the Platform is general information only. Verify with NLA, Tax Administration Jamaica, licensed surveyors, attorneys, and valuers before acting.
9. Limitation of liability
9.1
To the fullest extent permitted by Jamaican law, CaptureLand is not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or business opportunity, arising from use of the Platform.
9.2
Our aggregate liability for claims relating to the Platform (other than liability that cannot be excluded by law) is limited to the greater of (a) JMD 50,000 or (b) the fees you paid CaptureLand in the twelve (12) months before the claim. For free use, (b) may be zero.
9.3
These limits do not apply to death or personal injury caused by our negligence, fraud, or other liability that cannot be limited by law.
9.4
Where a third-party source, agent, or user supplies the underlying information, primary responsibility for that material remains with them, except where CaptureLand has independently caused loss through its own deliberate wrongdoing or negligence.
10. Indemnity
You agree to indemnify and hold harmless CaptureLand and its operators from claims, losses, and reasonable costs (including legal fees) arising from your User Content, your breach of these Terms, your unlawful use of the Platform, or decisions you make in reliance on Platform data without independent verification, except to the extent caused by CaptureLand’s deliberate wrongdoing or negligence.
11. Consumer rights
Nothing in these Terms excludes non-waivable consumer rights under Jamaican law, including rights under the Consumer Protection Act where applicable. You may contact the Consumer Affairs Commission about consumer matters.
12. Third-party links and services
12.1
The Platform may link to government portals, agents, listings, and companion products. We do not control and are not responsible for their content, terms, or privacy practices.
12.2
Your use of linked services is governed by their terms and policies.
13. Governing law and disputes
13.1
These Terms are governed by the laws of Jamaica.
13.2
The courts of Jamaica have non-exclusive jurisdiction, subject to mandatory consumer or constitutional provisions.
13.3
Before formal proceedings, the parties will attempt good-faith negotiation for 30 days after written notice using the contact details on our site. Either party may then refer the dispute to mediation through the Dispute Resolution Foundation (or successor). Arbitration under the Arbitration Act 2017 applies only by written agreement of the parties.
14. General
14.1
If any provision is invalid, the remainder stays in effect.
14.2
Failure to enforce a provision is not a waiver.
14.3
You may not assign your rights without our consent. We may assign our rights in connection with a reorganisation or sale of the Platform.
14.4
